As I mentioned earlier, the International Court of Justice will be announcing its judgment in the Bosnia-Serbia genocide case on Monday, February 26, at 10 a.m. GMT +1:00. The following day, Tuesday, February 27, at 14:00 GMT +1:00, the International Criminal Court will announce its first indictments in the Sudan Darfur investigations. The question for the ICC will be whether it names any Sudanese government officials in its indictments. This is a tough call. Sudan is not cooperating with the UN or the ICC, but indicting anyone in their government would probably make any future cooperation impossible. And without future cooperation from the Sudanese government, it is hard to see how the fighting will actually stop. This will be an important test for the ICC and its Chief Prosecutor.

And without future cooperation from the Sudanese government, it is hard to see how the fighting will actually stop. This will be an important test for the ICC and its Chief Prosecutor.

If they plan on being taken seriously, I don’t see how the ICC can pass up indicting government members just because of ongoing negotiations. By doing so, they would essentially be allowing the guilty to indefinitely delay their indictment via negotiation over the issue, whether it was in good faith or not.
